Rental Agreement

1. After the three minimum monthly payments have been made, customer has the choice of continuing the rental on a month to month basis or terminating the agreement by returning the instrument to TED BROWN MUSIC, provided the instrument is in good condition, reasonable wear and tear expected, and all rental payments are current to date of return. Customer must inform TED BROWN MUSIC of any address changes during the term of this agreement.
2. Customer must return the instrument in good condition to one of the locations listed at the bottom of this contract or contact TED BROWN MUSIC for return arrangements. Customer may be released from the terms of this agreement by fulfilling the three minimum monthly payments and upon receipt of instrument in good condition by TED BROWN MUSIC. If instrument is returned prior to 3 months, customer will be billed for the remainder of such minimum. Customer will be responsible for all damage not covered by Maintenance and Replacement Guarantee.
3. The instrument described on the reverse is on a rental basis only (Ownership will never transfer via this contract.) If the customer would like to purchase a band or orchestra instrument of equal or greater value the following will apply: After 12 months of continuous rental the customer will receive 10% off the TED BROWN MUSIC price. After 24 months of continuous rental the customer will receive 20% off the TED BROWN MUSIC price. After 36 months of continuous rental, and thereafter, the customer will receive 30% off the TED BROWN MUSIC price.
4. A late charge of $10.00 per month will be assessed on each installment more than 10 (ten) days past due. An insufficient funds fee of $40.00 will be charged for any bank draft dishonored for any reason.
5. If customer fails to make monthly payments as scheduled, the customer is obligated to either return the instrument to the store immediately, or pay the value price+ tax in full. Should default occur for more than 30 days on any monthly rental payment, TED BROWN MUSIC may take possession of the instrument and charge a repossession fee. Should collection or legal action be necessary to recover the instrument or money owed, customer agrees to pay reasonable fees.

Maintenance & Replacement Guarantee

1. TED BROWN MUSIC guarantees to provide repair service, at no charge, on the instrument due to normal wear and use; excluding willful damage. Supplies such as strings, reeds, and oils are not included. Customers who permanently mark their instrument or case will be charged for its replacement upon return of the instrument. Customers who attempt to repair the instrument on their own will be 100% responsible for any damage caused.
2. TED BROWN MUSIC guarantees to replace the instrument with one of comparable age and condition if the instrument is lost through fire or theft. Claim is subject to the instrument being in the student’s home or authorized school cabinet or room, and payment of a $50.00 fee. In connection herewith this replacement provision would be void if the instrument was lost in the corridor, street, playground or any unauthorized place.
3. Notification of loss must be made to school authorities and the police or sheriff’s office and to TED BROWN MUSIC within 10 days of occurrence or the replacement guarantee will be void and the customer will be liable for payment in full of the balance due under this security agreement. These guarantees will be declared totally void if payments are not current (within 10 days) at the time of loss or repair.

Acuerdo de Alquiler

1. Después de cumplir con el mínimo de tres pagos mensuales, el cliente tiene la opción de continuar con el alquiler en una base de mes por mes o terminar el acuerdo después de devolver el instrumento a TED BROWN MUSIC con el proviso que el instrumento este en buena condición, uso razonable y que los pagos estén corrientes a la fecha que se devuelva. El Cliente le debe avisar a TED BROWN MUSIC de cualquier cambio de domicilio durante este acuerdo.
2. El Cliente debe devolver el instrumento en buenas condiciones a una de las tiendas enlistadas en la parte inferior de este contrato o contactar a TED BROWN MUSIC para arreglar su devolución. El Cliente estará libre de los términos del contrato al cumplir los tres pagos minimos y al regresar el instrumento en buenas condiciones a la tienda TED BROWN MUSIC.
3. El instrumento descrito en la página anterior está solamente bajo los términos de alquiler. (La propiedad nunca será transferida a través de este contrato). Si el cliente quiere comprar un instrumento para banda u orquesta del mismo valor o más, se aplicará lo siguiente: Después de 12 meses de renta continua el cliente recibirá un 10% de descuento del precio del instrumento. Después de 24 meses de renta continua el cliente recibirá un 20% de descuento del precio del instrumento. Después de 36 meses de renta continua el cliente recibirá un 30 % de descuento del precio del instrumento.
4. Pagos recibidos más de 10 (diez) días tarde tendrán una multa mensual de $10.00. Se le cobrará un cargo de $40.00 por cada giro bancario devuelto por fondos insuficientes y por cualquier transacción bancaria deshonrada por cualquier razón.
5. Si el cliente no cumple con los pagos mensuales, está obligado a devolver el instrumento a la tienda inmediatamente, o pagar el precio del valor indicado en el contrato más los impuestos (el tax) por completo. Si un pago no se puede cobrar por fondos insuficientes por más de 30 dias, TED BROWN MUSIC reserva la autoridad para tomar posesión del instrumento y cobrar una multa. Sí colección o acciones legales son necesarias para recobrar el instrumento, o el dinero adeudado, el cliente acepta pagar las multas.

Garantia de Mantenimiento y Reemplazo

1. TED BROWN MUSIC garantiza proveer servicio de reparación, sin ningún cargo, al instrumento debido a uso normal. Excluyendo daño hecho intencional o debido a la falta de cuidado. Cuerdas, cañas, y los aceites para instrumentos no estan Incluidos. A los clientes que marquen el instrumento o estuche se les cobrará por el reemplazo del mismo, al regresarlo a la tienda. Clientes que intenten arreglar el instrumento por si mismos serán 100% responsables por cualquier dano causado.
2. TED BROWN MUSIC garantiza reponer el instrumento con uno de edad y condición comparable si el instrumento se pierde por incendio o robo. La reclamación está sujeta a que el instrumento haya estado dentro de la casa del estudiante o del gabinete escolar autorizado y a una multa de $50.00. Pero la garantía de reemplazo sera nula e inválida si el instrumento se pierde en el corredor, la calle, el campo o cualquier otro lugar que no este autorizado.
3. La notificación de su pérdida se tiene que reportar a las autoridades escolares, la policía u oficina del sheriff, y a TED BROWN MUSIC dentro de 10 dias del. incidente o la garantia de reemplazo se anulara y el cliente sera responsable de pagar el valor completo indicado en este contrato. Esta garantia sera declarada totalmente nula si los pagos no están al corriente (ENTRE 10 días) al momento de la perdida o reparacion.
